Skill Shop provides an online platform that connects teachers that have lessons to list and book with learners that are seeking to book such lessons (collectively, the "Services"). The Services are accessible at skill-shop.com (the "Site")

The Site and Services are provided by Skill Shop International Ltd. (t/a Skill Shop), a company registered in England under company number 10546371 and whose registered office is at City Gates, 2-4 Southgate, Chichester, West Sussex, United Kingdom, PO19 8DJ, ("Skill Shop", "us", "we" or "our" for short). "You" and "your" means you as the user of our Site and Services.

By visiting the Site and/or using the Services, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service ("Terms") and any Terms referenced within via hyperlink. If you do not agree to these terms, you have no right to obtain information from or otherwise continue to use the Site or Services. Failure to use the Site or Services in accordance with these Terms may subject you to civil and criminal penalties.

The Terms include, but are not limited to:

  1. Your rights to use and link to our Site
    ("Website Terms of Service")
  2. How we will use and protect information about you
    ("Privacy Policy")
  3. Our Booking Terms and Conditions in relation to the booking of third party Services
    ("Booking Terms and Conditions")

These Terms do not govern the relationship between Skill Shop and our Teachers. Existing Teachers can consult the Teacher Terms provided upon signup, and potential Teachers can apply with Skill Shop at skill-shop.com/teach

Any new features, tools or listings which are added to Skill Shop shall also be subject to the Terms. These Terms may be updated from time to time, in which case the most up to date version will be available via the Site. It is your responsibility to check these Terms periodically for changes. You will be deemed to have accepted any updates to the Terms by continuing to use the Site and/or Services.

The Site and Services comprise an online platform through which Teachers may create listings for Lessons and Learners may learn about and book Lessons directly with the Teachers. You understand and agree that Skill Shop is not a party to any agreements entered between Teachers and Learners, nor is Skill Shop a Broker, Agent or Insurer. Skill Shop has no control over the conduct of Teacher, Learners or other users of the Site, Services or and Lessons, and disclaims all liability in this regard to the maximum extent permitted by law.

 


 

Website Terms of Service

  1. Use Of The Website

    1. Access to our Site is permitted on a temporary basis. We reserve the right to withdraw or amend our Site without notice. We will not be liable if for any reason our Site or any part of it is unavailable at any time or for any period.
    2. We update our Site from time to time and so may change the content at any time without notice to you. We reserve the right to withdraw, vary or change any element of the Site at any time without notice.
    3. Materials or Information posted on our Site are not intended as advice and should not be relied upon as such. We therefore disclaim all liability arising from any reliance placed on such information to the fullest extent permissible by law.
    4. You are responsible for ensuring that all persons accessing the Site through your internet connection are aware of these Terms.
    5. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
    6. You must not transmit any worms or viruses or any code of a destructive nature.
    7. A breach or violation of any of the Terms will result in an immediate termination of your access to the Site and any applicable Services.
  2. General Conditions

    1. We reserve the right to refuse service to anyone for any reason at any time.
    2. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
    3. Credit card information is always encrypted during transfer over networks.
    4. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
    5. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
    6. The Site and Services are intended solely for persons who are 18 or older. Any access to or use of the Site, Application or Services by anyone under 18 is expressly prohibited. By accessing or using the Site, Application or Services you represent and warrant that you are 18 or older.
  3. Accuracy, Completeness And Timeliness Of Information

    1. We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
    2. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
  4. Modifications To Services And Prices

    1. Prices for Services are subject to change without notice.
    2. We reserve the right at any time to modify or discontinue Services (or any part or content thereof) without notice at any time.
    3. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of Services.
  5. Accuracy Of Billing And Account Information

    1. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
    2. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
  6. Optional Tools

    1. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
    2. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
    3. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
    4. We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

    1. Certain content, products and services available via our Site may include materials from third-parties.
    2. Third-party links on this Site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
    3. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
  8. Errors, Inaccuracies And Omissions

    1. Occasionally there may be information on our Site or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
    2. We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
  9. Prohibited Uses

We reserve the right to terminate your use of the Services or any related Site for violating any of the prohibited uses.
  10. Disclaimer Of Warranties; Limitation Of Liability

    1. We do not guarantee, represent or warrant that your use of our Site will be uninterrupted, timely, secure or error-free.
    2. We do not warrant that the results that may be obtained from the use of the Site will be accurate or reliable.
    3. You agree that from time to time we may remove the Site for indefinite periods of time or cancel the Site at any time, without notice to you.

In no case shall Skill Shop, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Site, or for any other claim related in any way to your use of the Site, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Site or any content posted, transmitted, or otherwise made available via the Site, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
  11. Indemnification

You agree to indemnify, defend and hold harmless Skill Shop and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
  12. Severability

    1. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
  13. Termination

    1. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
    2. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
    3. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Site(or any part thereof).
  14. Entire Agreement

    1. The failure of us to exercise or enforce any right or provision of these Website Terms of Service shall not constitute a waiver of such right or provision.
    2. These Website Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
    3. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

    1. These Website Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with English Law.

Privacy Policy

  1. What Do We Do With Your Information?

    1. When you make a purchase from the Site of a third party Service, as part of the process, we collect the personal information you give us such as your name, address and email address.
    2. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
    3. Email marketing: With your permission, we may send you emails about our store, new products and other updates.
  2. Consent

    1. How do you get my consent?

      1. When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

    1. We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
  4. Shopify

    1. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our Services to you.
    2. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
    3. Payment:

      1. If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
      2. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
      3. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

  5. Third-party Services

    1. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
    2. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
    3. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
    4. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
    5. Links:

      1. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

    1. To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
    2. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

    1. Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

      1. _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
      2. _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
      3. _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
      4. cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

      6. storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
    2. Google Analytics is used to track how ianrankin.net is used by visitors, it tracks your progress through the site and how you were referred to skill-shop.com. We don’t collect or store your personal information through Google Analytics – this information can’t be used to identify who you are.

        2. _gat,  Used to manage the rate at which page view requests are made
        3. _utma, Similar to _ga this let’s us know which parts of the site you’ve previously visited

    Booking Terms and Conditions

    Please read these Booking Terms and Conditions carefully before you complete any transactions via the Site, as these "Booking Terms and Conditions" will apply to your transaction. We recommend that you print a copy of these Booking Terms and Conditions for future reference. If you do not agree with these Booking Terms and Conditions, you must not use our Site to make a booking.

    Defined Terms

    For ease of reference the following terms shall have the following meanings in these Booking Terms and Conditions:

    "Learner", "Customer", "you" and "your" means you, the buyer of any Services;

    "Dated Booking" means an appointment at a specific time/date with a particular Teacher for the provision of Services;

    "Voucher" means a Voucher sold  on the Site which can be used for the purchase of Services from a particular Teacher selected at the time of purchasing the Voucher.

    "Order" means either an order for Services or an order for a Voucher

    "Order Confirmation" means as defined in clause 3.3

    "Teacher(s)" means our selected third party providers of Services who offer their Services for sale via our Site;

    "Teacher Contract" means the agreement between you and the Teacher upon a confirmed order, as defined in clause 1.3.1

    "Teacher Terms and Conditions" means any Teacher terms and conditions of sale and/or of business (including without limitation that Teacher’s privacy policy, booking policy, delivery policy, health and safety policy, and returns/refund policy – as applicable);

    "Services" means any services of a Teacher offered for purchase or booking via the Site;

    "Skill Shop Contract" means the agreement between you and Skill Shop as a commercial agent upon a confirmed order as defined in clause 1.3.2

    1. Third Party Services

      1. The Site allows you to book and pay for Services from a variety of third party providers (our Teachers). Those Services are provided by our various Teachers and not by us. Skill Shop is responsible for taking and concluding your bookings as the commercial agent of the relevant Teachers. The provision of the Services booked via our Site is the responsibility of the Teacher which provides them. Skill Shop are not responsible or liable to you for the actual Services that are booked through the Site (including those Services purchased using Vouchers).
      2. In the event you pay for Services via the Site, then your payment will either be paid directly to the relevant Teacher or will be received by us acting as commercial agent on behalf of the Teacher. If we receive payment as commercial agent on behalf of the relevant Teacher, our receipt of the correct payment will discharge your debt to that Teacher.
      3. When you purchase Services using the Site, it will create two binding legal contracts:

        1. A contract between you and Skill Shop (under which Skill Shop has certain responsibilities to you in relation to the purchase or booking) (the "Skill Shop Contract"). That contract is made based on these Booking Terms and Conditions; And
        2. A contract between you and the relevant Teacher in respect of the provision or supply of the Services which you book through the Site (the "Teacher Contract"). That contract is subject to certain provisions of these Booking Terms and Conditions and may include separate Teacher Terms and Conditions, which we will notify you of before you make a booking either on the relevant Teacher's page on the Site or via a link to such Teacher Terms and Conditions from that Teacher's page on the Site.
    2. Updating the Booking Terms and Conditions

      1. We amend these Booking Terms and Conditions from time to time. Every time you wish to make a transaction on the Site, please check these Booking Terms and Conditions to ensure you understand the terms which will apply at that time.
    3. Orders

      1. There are two types of orders for Services ("Order") you can make on the Website:

        1. A Dated Booking;
        2. The purchase of a Voucher for a Service of a particular Teacher.
      2. The Order process allows you to check and amend any errors before submitting your Order to us. Please take the time to read and check your Order at each stage of the Order process and before finally submitting your Order.
      3. We are appointed as the commercial agent of the Teacher to conclude bookings on its behalf and the Teacher Contract will be formed when we send you a written confirmation (usually by email) ("Order Confirmation").
      4. In respect of Orders for Vouchers, receipt of an electronic voucher (if earlier) will count as an Order Confirmation.
      5. We reserve the right to withdraw access to our Site and/or cancel any Order in the event that you fail any credit or fraud prevention check or where we reasonably suspect fraud or money laundering by you or someone using your account.
    4. Rescheduling

      1. For Dated Booking Orders, if you wish to reschedule your appointment details (time/date) (in whole or in part) after you have received an Order Confirmation, provided your appointment is not due to take place within the next 72 hours, then please contact us and we will endeavour to offer you a suitable alternative booking time and/or date. If we are unable to accommodate your request to reschedule your appointment:

        1. If you contacted us to do so within 24 hours of receiving your Order Confirmation, we will offer you a refund in respect of the part of your Order which we are unable to reschedule; or
        2. if you contacted us to do so 24 hours or more from receiving your Order Confirmation, provided the appointment was not due to take place within the next 72 hours from the time you asked to reschedule, we will offer you a credit note in respect of the part of your Order which we are unable to reschedule.
      2. You can contact us to reschedule an appointment at team@skill-shop.com, via the Site, or via telephone (number listed on Site and Order Confirmation). Please note that our ability to accommodate your request will be subject to the Teacher’s availability during the time you wish to reschedule.
    5. Services

      1. Our Teachers are under a legal duty to provide Services that are in conformity with the relevant Teacher Contract.
      2. All Services shown on the Website are subject to availability and the images and/or descriptions of the Services on the Site are for illustrative purposes only and actual Services may vary from those images and/or descriptions. We require our Teachers to ensure that all information provided by them for display on their page of the Site is accurate, complete and not misleading in any way but we cannot verify the information which they provide to us. It will be each Teacher's responsibility to ensure that all of its Services listed on the Site are available and accurately described.
      3. If you are a consumer, you have legal rights in relation to Services that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Booking Terms and Conditions will affect these legal rights.
      4. It is your (or the person receiving the Services) sole responsibility to communicate in advance any medical or health-related conditions and/or special needs to the Teacher that might affect or be affected by any Services (for example without limitation, allergy information and health issues). Subject to clause 10.3, if you (or the relevant recipient of the Services) fail to disclose any such information to the applicable Teacher, neither Skill Shop nor the relevant Teacher shall be liable to you (or the recipient of the Services) for any injury, loss or damages resulting from the Services that could reasonably have been avoided if you (or the recipient of the Services) had disclosed that information prior to receiving the Services.
    6. Cancellations

      1. In addition to your other legal rights, you may in certain circumstances have the right to cancel a Teacher Contract and/or Skill Shop Contract (as applicable) and receive a refund or a credit note in accordance with the terms set out in this clause 6. If you change your mind about an Order for a Dated Booking or a Voucher and wish to cancel it, the following cancellation terms apply:
      2. Dated Bookings

        1. If you cancel (in whole or in part) a Dated Booking within 24 hours of receiving your Order Confirmation, provided the applicable Service is not due to take place within the next 7 days, you will be entitled to a refund of the applicable amount via the original method of payment. If the appointment is due to take place within the next 7 days, you will not be entitled to any refund or credit note.
        2. If you cancel (in whole or in part) a Dated Booking more than 24 hours after receiving your Order Confirmation provided the applicable appointment is not due to take place within the next 72 hours , you will be entitled to a credit note for the applicable amount which must be redeemed on the Site within six months of receipt by you of such credit note. If the appointment is due to take place within the next 72 hours, you will not be entitled to any refund or credit note.
        3. If permitted by these Booking Terms and Conditions and the relevant Teacher Terms and Conditions, cancellations of Dated Bookings must be made by one of the following methods: Email to team@skill-shop.com, contact us via the Site, or via telephone (Current number listed on Site and Order Confirmation).
        4. In a small number of circumstances, it may not be possible to cancel a dated booking, normally where a substantial amount of preparation must be taken by the teacher. If this is the case, we will draw this to you attention before you place your order so you can decide whether to proceed on this basis.
      3. Vouchers

        1. If you cancel (in whole or in part) a Voucher within 14 days of receiving your Order Confirmation, provided you have not yet redeemed the applicable Voucher by making an appointment for the Services with the relevant Teacher, a refund of the applicable amount via the original method of payment is possible.
        2. If you cancel (in whole or in part) a Voucher more than 14 days after purchasing it, provided you have not yet redeemed the applicable Voucher by making an appointment for the Service with the relevant Teacher or by using the Voucher to redeem against another purchase, and provided the Voucher has not yet expired, you will be eligible for a credit note for the applicable amount, which must be redeemed on the Website within six months of the date of issue of such credit note.
        3. If permitted by these Booking Terms and Conditions and the relevant Teacher Terms and Conditions, cancellations of Vouchers must be made by one of the following methods: Email to team@skill-shop.com, contact us via the Site, or via telephone (Current number listed on Site and Order Confirmation).
        4. No refund will be given where a Voucher has been fully redeemed against a Service.
    7. Resolving Issues

      1. We care about your experience and want to ensure we maintain the highest standards possible and so if you would like to make a complaint about one of our Teachers or their Services, please email us at team@skill-shop.com, contact us via the Site, or call us via Telephone (Current number listed on Site and Order Confirmation).
      2. Following receipt of a complaint we will contact the relevant Teacher to try and resolve the issue on your behalf. If we are unable to resolve the issue following contact with the Teacher, if we consider it to be fair in all the circumstances, we may at our sole discretion elect to:

        1. give you a credit note for the disputed/complained about amount of your Order (to be redeemed on the Website to reduce the purchase price of any Services); or
        2. as a last resort or in extreme circumstances and always at our sole discretion refund the disputed/complained about amount directly to you via the original method of payment. Please note that it might take up to 30 days to receive a full refund in such cases.
      3. Further or alternatively, if you are unhappy with the Services received from a Teacher pursuant to an Order, you can also:

        1. Speak to the Teacher yourself to try and resolve the issue; and/or
        2. Leave an honest review on the Website or via the App to reflect your experience.
      4. While we take all complaints about our Teachers very seriously and will always do what we can to help to resolve them, we are not responsible to you for the service(s) which the Teachers provide and are under no obligation to provide you with a refund or credit note in the event you are dissatisfied with services which you have received from our Teachers.
    8. Vouchers

      1. When you order a Voucher for a particular Service with a particular Teacher, you will need to contact the relevant Teacher yourself in order to set the time/date of the appointment.
      2. Vouchers are cancellable in accordance with the cancellation terms set out in clause 6.3.
      3. The expiry date of a Voucher is 12 months from its issuance. The expiry date can be found on the Voucher itself. Please check this carefully and if you are unclear as to the expiry date of your Voucher please contact us at team@skill-shop.com
      4. A Voucher can only be redeemed with the relevant Teacher identified in the Order. If you want to change the Teacher with whom your Voucher can be redeemed, you will need to contact Skill Shop by emailing us at team@skill-shop.com, contacting us via the Site, or calling us via Telephone (Current number listed on Site and Order Confirmation). and Skill Shop may at its discretion arrange for the reallocation of the Voucher to an alternative Teacher. Please note however that Skill Shop is not obliged to do so in these circumstances.
    9. Price and payment

      1. Prices and any applicable processing charges will be as quoted on the Site from time to time, but may be subject to change by Skill Shop or Teachers at any time (in which case the Site will be updated accordingly, but changes will not affect Orders in respect of which you have already been sent an Order Confirmation prior to the date the change is published on the Site). In the situation when you have ordered a Voucher before a price change, then the Voucher will be taken as sufficient payment for the applicable services, with approval from the relevant Teacher. If approval is not given, a credit note will be provided.
      2. The Site contains details of a number of Services and it is possible that, despite Skill Shop's best efforts, some of the pricing and other information shown for certain Services is incorrect.
      3. Payment for all Services must be made at the time of booking in pounds sterling by credit or debit card using the online payment facility ("Payment Facility") Any currency conversion costs or other charges incurred by you in making a payment will be borne by you in addition to the price due to us.
      4. Payments made through the Payment Facility are processed by third party payment services providers. Skill Shop takes reasonable care to ensure that the Payment Facility is available and functioning at all times, but cannot guarantee continuous, uninterrupted or secure access to such Payment Facility, nor can we guarantee that the facility is virus or error free. We use third party payment service providers to process payments and because there are many factors beyond our control (such as delays in the banking system or in card networks), we cannot predict or guarantee the amount of time needed to complete the processing of your payment.
      5. Access to the Payment Facility may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to provide reasonable notice of any scheduled interruptions to such Payment Facility and will do what we can to restore the facility as soon as reasonably possible.
      6. If you pay for Services via the Payment Facility, Skill Shop will collect the payment in its capacity as the commercial agent of the relevant Teacher. Once Skill Shop has successfully received your payment for the Services, this will discharge your debt to the Teacher on whose behalf Skill Shop has collected the payment.
    10. Liability

      1. Where we have been negligent and/or breached a contractual obligation to you, we will be liable for any loss or damage you suffer as a result, provided that loss and/or damage is foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our negligence or breach of contract, or would have been considered by you and us to be a likely consequence of it at the time we entered into the Skill Shop Contract.
      2. We do not accept any liability for the following types of loss, whether caused by breach of contract, tort (including negligence) or otherwise, even if the loss is foreseeable: loss of income or revenue; loss of business; loss of profits; loss of anticipated savings; loss of data; or waste of management or office time.
      3. We do not exclude or limit our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under English law.
    11. Our right to vary these Booking Terms and Conditions

      1. We may revise these Booking Terms and Conditions from time to time in the following circumstances:

        1. If we change the process for accepting payment from you;
        2. If there are changes in relevant laws and regulatory requirements; and/or
        3. If there are any other changes to our business that reasonably means we need to amend these Booking Terms and Conditions.
      2. Every time you order Services via the Site, the Booking Terms and Conditions in force at that time (and available for view on the Site) will apply to the Skill Shop Contract between you and us and the Teacher Contract between you and the Teacher. You can find the date on which these Booking Terms and Conditions were last updated at the top of this page.
    12. General

      1. All communications and notices from you must be sent to Skill Shop by email at team@skill-shop.com,  via the Site, or via Telephone (Current number listed on Site and Order Confirmation). Skill Shop may communicate and give notice to you via post, email or by posting notices on the Site.
      2. Please note our customer support hours are: 9am-5pm Monday to Friday.
      3. If any of these Booking Terms and Conditions are determined by a competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
      4. These Booking Terms and Conditions will be governed by and construed in accordance with the laws of England. You and we each agree that the English courts will have non-exclusive jurisdiction over any claim or dispute arising from, or related to, the ordering and/or supply of Services via the Site
